Release Reporting and Notification

Federal and state regulations require notification and reporting in the event of a “reportable release” defined as spills and releases of regulated materials to the environment in excess of federal or state-authorized quantities. Certain releases must be reported immediately to the National Response Center (“NRC”), the applicable State Emergency Response Commission, (“SERC”) and to the Local Emergency Planning Committee (“LEPC”). Furthermore, some releases may require reporting to the applicable federal and state agency within an allotted time period. Other releases do not require reporting; however, should be noted in the site’s operating record. Failure to properly record and/or report the details of a regulated material release may lead to severe penalties. This presentation will consolidate federal and Texas specific regulations for releases of regulated materials to all environmental media, describe the responsibilities of personnel at the time of a release, and provide agency contact information.
